Report from the Commission on the implementation Framework Decision 2004/7577JHA laying down minimum provisions on the constituent elements of criminal acts and penalties in the field of illicit drug trafficking

The Commission considers that Article 4(2) has been satisfactorily implemented in terms of the scale of penalties… offences relating to drug trafficking within the framework of a criminal organisation are subject to much higher sentences than those established in the Framework Decision, and we can conclude that the penalty scales are respected.
